Terms of Service

1. Acceptance of Terms

By accessing or using LakeMate ("the Service"), including the AI-powered Lake Concierge chat feature, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. AI-Generated Content Disclaimer

LakeMate uses artificial intelligence to generate responses. All information provided by the AI concierge — including but not limited to boating regulations, lake conditions, fishing advice, restaurant recommendations, marina details, and local business information — is generated by AI and may be inaccurate, incomplete, outdated, or misleading.

You must independently verify all information before relying on it, especially:

  • Boating rules, speed limits, and regulations (verify with CT DEEP and the Candlewood Lake Authority)
  • Lake conditions, water levels, and weather (check official sources and current conditions)
  • Safety-related guidance of any kind
  • Business hours, pricing, availability, and contact information
  • Fishing regulations and licensing requirements

LakeMate is not a substitute for official guidance from the Connecticut Department of Energy and Environmental Protection (CT DEEP), the Candlewood Lake Authority (CLA), local municipalities, or any other official body. The AI does not have access to real-time data and cannot account for current conditions, recent regulatory changes, or emergencies.

3. Assumption of Risk

Boating, fishing, swimming, and all water-related activities carry inherent risks, including the risk of serious injury or death. By using LakeMate, you acknowledge that:

  • You are solely responsible for your own safety and the safety of your passengers
  • You assume all risk for decisions made based on information provided by the Service
  • You will not rely on AI-generated responses as your sole source of safety or regulatory information
  • You are responsible for complying with all applicable federal, state, and local laws and regulations

4. No Warranty & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LAKEMATE AND ITS OPERATORS, AFFILIATES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • Any reliance on AI-generated information
  • Errors, inaccuracies, or omissions in AI responses
  • Personal injury, property damage, or financial loss
  • Interruption or unavailability of the Service
  • Actions taken or not taken based on information provided by the Service

5. Indemnification

You agree to indemnify, defend, and hold harmless LakeMate and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.

6. Sponsored & Featured Content

LakeMate may feature local businesses through paid partnerships. When AI responses include sponsored or promoted business recommendations, they will be clearly identified as such. Sponsored placement does not constitute an endorsement by LakeMate. You should independently evaluate any business before engaging their services.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to manipulate or abuse the AI system
  • Submit harmful, abusive, or offensive content through the chat
  • Use the Service to generate content that violates any third party's rights
  • Interfere with or disrupt the Service's infrastructure

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Chat messages may be processed by third-party AI providers to generate responses.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.
